英文摘要 | According to the "Period of Performance" chapter in the public works procurement contract template, it is stipulated that "except for force majeure such as natural disasters or accidents, the manufacturer shall not request an extension of the performance period for any reason." , while in "Delay in Contract Performance", it is stated that "agencies and manufacturers who fail to perform the contract on time due to force majeure such as natural disasters, accidents or reasons not attributable to the parties to the contract may extend the time limit for performance of the contract; exempt from contractual liability." and by way of example war, hostilities (whether war be declared or not), invasion, act of foreign enemies, rebellion, terrorist attack, revolution, insurrection, military seizure of power, coup, civil war, riot, commotion, disorder, strike or lockout of which the Contractor is not involved; and the contractor is not involved in munitions, explosive substances, nuclear radiation or radioactive pollution; and natural disasters such as earthquakes, hurricanes, typhoons or volcanic eruptions, etc. According to the above-mentioned contract, the requirement for the applicant to extend the performance period is based on whether it is "force majeure or reasons not attributable to the parties to the contract", instead of depending on whether it is still within the "performance period" in the contract.However, in article 45 of the purchase contract, the number of overdue days is calculated in units of days, and there is no distinction between working days, calendar days, and holidays.
