中文摘要 | 我國政府於1998年要求各部門推動性別主流化政策,立法部門亦於100年通過「消除對婦女一切形式歧視公約施行法」健全婦女發展,落實保障性別人權及促進性別平等,而司法機關是於2005年推動相關性別主流化政策,當然也表現在婚姻事件法令的改革。婚姻事件橫跨公領域與私領域,包括離婚、子女監護、財產分配、親子關係、家庭暴力等,而家庭私權爭訟案件中又以「離婚」事件為主,以2011年臺灣花蓮地方法院「婚姻」事件判決為例計100件中「離婚」事件就佔了51件,超過半數以上,一般而言,當事人主張離婚是認為對方要擔負婚姻破裂的責任,而責任從性別關係的視域是否存在多元的認定標準,是社會的意義?文化的意義?還是司法的意義?或是一種任意想法?故法官進行離婚案件審理時是否具性別意識以及如何生產及論述?又如何理解詮釋法官審理案件的性別態度為本研究之焦點。本研究方法以女性主義法學及多元文化理論為立論基礎,透過深入訪談三位資深家事法官及論述分析,以梳理及建構家事法庭法官對於婚姻事件審理的性別圖像。 |
英文摘要 | The government had requested every department to promote Gender Mainstreaming Policy in 1998, and legislative departments had promoted women's development through the Convention of Eliminating Discrimination of all Forms on Womenin 2011 to guarantee gender human rights and to promote gender equality. Judicial authorities promoted relevant gender mainstreaming policies in 2005 and also made legal reforms on marriage related lawsuits. Marriage events contain common and private aspects, including divorce, children custody, property distribution, parenthood, family violence, etc. Divorce cases dominate family privacy litigation cases. Taking marriage cases in Taiwan Hualien District Court in 2011 as an example, divorce cases accounted for 51 among 100 cases, more than half of the total. Generally speaking, the litigant insisting divorce thinks that the other party should assume responsibility of the breaking down of the marriage. However, is there a multiple identification standard in view of gender relation? Is it related to society, culture or justice? Even for one arbitrary thought, does the judge have gender consciousness when judging divorce cases? If so, how is this shown? The focus of this study is how to understand and interpret the attitude of judges towards gender when judging a case. Through a comprehensive interview with 3 professional judges and their analysis, this study takes the feminist law and multicultural theory as the basis, to sort out and construct the gender sensitivity image of judges in family courts when judging marriage cases. |
