中文摘要 | 勞工在一定的工作期間後,必須有一段的休息時間,讓勞工的生理及心理上獲得 休憩,否則日以繼夜的工作,勞工無法得到適當的休息,除可能損害勞工的生活品質 外,對勞工的生產力亦可能造成效率及安全上的影響。因此勞基法就休息及假日定有 明文規範,除使勞工的勞動權益獲得法律保障外,亦能使勞工的身心靈健康維持基本 的品質。休息與假日在勞基法中皆屬於勞工不須出勤之情況,而假日在勞基法中又可 分為例假、休假及特別休假,三者間的產生原因及要件不同,於該日出勤所衍生的效 果亦有所差異,此乃攸關藥師勞動權益,藥師執業時不得不加以留意。 |
英文摘要 | After work for a certain period of time, labor can permitted to have a break on physical and mental stress by a length of recess. Working around the clock without appropriate recess not only reduce the quality of life, but influence the efficiency and safety of labor. Therefore, recess and vacation are stipulated by a statute in Labor Standards Act, which makes the labor rights and health of labor can be protected. Vacation are divided into Regular day off, Holidays, and Annual paid leaves in Labor Standards Act, there is difference between the juridical act and consequences by different cause of vacation, pharmacists should pay more attention on this issue in clinic practicing. |
