中文摘要 | 公寓大廈管理條例第5條規定,區分所有權人對專有部分之利用,不得有妨害建築物之正常使用及違反區分所有權人共同利益之行為。有無違反共同利益,不應只從財產管理的側面、更應該從共同生活的側面,甚至認同參與的側面來加以考量。本文嘗試去分析「違反共同利益行為」此一不確定法律概念的內涵,並歸納其行為類型及判斷標準。至於對「違反共同利益行為」的法律效果,雖包含各種行政責任及民事責任,甚至強制遷離、強制出讓或拍賣等高度限制權利行使的行為,然本文認為,適用上仍應考慮團體性、必要性及比例原則等法律原則。期能減低磨擦,凝聚社區共識,提升生活品質,達到多元共生的和諧社會。 |
英文摘要 | In the Condominium Administration Act Building Administration Division Article 5:"When using their individual unit, unit owners may not engage in any practice that is impairing the proper use of the building or violating the common interests of all unit owners." Whether the breach of common interest, not only from the side of the property management, should live together from the side, or even agree with the side to be involved in considerations. This paper attempts to analyze and summarize "violations of common interests" this uncertain legal connotation of the concepy and to establish their behavior types and criterion.As regards the legal effect of "violations of common interests", although included: a variety of administrative responsibility and civil liability, or even forced evictions, forced to sell or auction the right to exercise a high degree of restriction of behavior, then paper argues, should be considered on a group of applicable legal principles such as the principle of proportionality and necessity. |
