中文摘要 | 依據消費者保護法第 17條第 1項,行政院衛生署 96年公告「餐飲業等商品 (服務 )禮券定型化契約應記載及不得記載事項」,並於 100及101年分析各縣市衛生局稽查觀光飯店、咖啡店、連鎖速食業、餐廳餐券 474張之符合情形, 100年稽查 160張餐券 (合格 143張,不合格 17張);101年稽查 314張餐券 (合格 271張,不合格 43張),2年合格率皆接近 9成,結果顯示市場佔有電子型式之餐券已達到 5%以上,掛失機制、記名或不記名之換卡費用尚未建立,禮券由第三人 (非實質企業經營者 )發行者佔多數。不合格項目以未記載履約保證、負責人姓名及限制使用期限最為嚴重。 100至101年度之稽查除為提醒餐飲業者遵守政府法令外,亦可藉此強化業者契約觀念,保障我國民眾之餐飲消費權益。 |
英文摘要 | According to paragraph 1 of article 17 of the Consumer Protection Law, the dining voucher is subject to the “Notices to be noted and not be noted by standard contracts of dining (service) vouchers” promulgated by the Department of Health, Executive Yuan in 2007; therefore, the county and city health bureaus audited such voucher coupons issued by tourist hotels, cafeterias, fast food chains and restaurants accordingly and the conformity of 474 vouchers in 2011 and 2012 was subsequently analyzed by FDA. The conformity totaled near 90% as follows: a total of 160 vouchers audited in 2011 where there were 143 with conformity and 17 inconformity; a total of 314 vouchers audited in 2012, and 271 with conformity and 43 inconformity. According to the results, e-coupons with a total market share of more than 5% are in need of the mechanism for the lost ones and renewed charges for personal and general use ones. In the meantime, such vouchers are almost always issued by third parties rather than the actual business operators. The items with high rates of inconformity are as follows: assurance of performance, name of responsible person and time limit of dining vouchers not noted. In accordance with the results, the concept of standard contracts is enhanced in order to protect the rights of consumers in dining as well as a reminder of compliance for the business operators. |
