英文摘要 | There is no literature on the most frequently-raised issues in administrative appeal cases regarding condemnation compensation for land, crops, and fixtures. Neither are there discussions on whether the reasoning in those appeal cases is flawed. This paper is the final episode of my takings compensation articles trilogy. In the preceding two articles, I discussed takings compensation issues from the angle of constitutional interpretations, statutory interpretations and reforms, and judicial decision-making. Here I explore how to implement the constitutional and statutory requirement of takings compensation in the administrative appeal procedure. I sampled administrative appeal cases rendered by the Administrative Appeal Review Committee under the Ministry of the Interior (MOIRC) between 2006 and 2009, coding 244 such cases. I find that in land condemnation compensation cases, appellants were usually unsatisfied with under-compensation, while in crops and fixture condemnation compensation cases, appellants often disputed the condemnors’ claims that they raced to grow crops after they learned of the forthcoming condemnation. These types of factual disputes require non-legal expertise to properly handle. Nevertheless, the MOIRC has taken an extremely deferential stance to the administrative agencies and dismissed the cases if there is no procedural defect in the decision-making processes, leaving substantive issues mostly un-reviewed. Thus, very few appellants have successfully persuaded the MOIRC to amend the original decisions. In the light of the empirical observations, this paper suggests several ways to reform the administrative appeal procedure, especially the division of labor and cooperation between the administrative appeal procedure and the mandatory reconsideration procedure. |
