英文摘要 | Cloud computing recently has been viewed as the "paradigm shift" in the information economy. Software and hardware vendors and various Internet service providers have invested intensively in relevant technologies and services. In the cloud environment, users no longer use their own hardware to store data and deal with computing activities. Computing takes place in the remote server and users only pay for the capacity they really use. Therefore, cloud computing enables users to save significant costs in hardware architecture establishment and to focus on their core capability. In the meantime, cloud computing has led to a series of legal issues. First, privacy and information security issues emerge because the data is flowing between remote servers. The distributed nature of cloud computing also makes privacy a transnational legal issue. If data loses because of the technical problems of the cloud, dispute will come into sight on who should bear the risk. Moreover, when network providers with market power come into the cloud computing market, network neutrality should be taken into account by the government. Finally, cloud computing also brings about copyright uncertainties associated with software licensing and Internet service provider immunity. |
