中文摘要 | 本文係描述德國威瑪憲法第二部分基本權利與基本義務章節之歷史發展。威瑪共和是一九一八年十一月革命的結果,一方面結束德國君主制;一方面開啟德國民主共和。整個威瑪制憲過程,在政治上,自最早爭議基本權是否入憲之議題以及過程中政府草稿數次變動,而最後以「基本權之父Konrad Beyerle」擴張版本取代了「憲法之父Hugo Preuß」的謙抑政府版本。其中,各政黨之參與及意見表達也反映出當時社會與政治上對於基本權意義與理解之變遷。學術上,威瑪憲法第二部分對於當時國家法學者而言乃是屬於新的領域,因為多數規定已非十九世紀自由權的概念所能理解掌握。而當時國家法學「方法與方向論之爭論」也助長基本權解釋與基本權理論之開展。這時期的理論影響了一九四九年德國聯邦共和的基本權理論重新形成。惟當時不利的政治現實條件,卻使得制憲者與學術的努力,於一夕間在一九三三年因國家社會主義政黨而化為烏有。 |
英文摘要 | This article describes historical development of the second part of the German Weimar Constitution - fundamental rights and fundamental obligations. Weimar Republic arose from the revolution in November 1918. It ended the German monarchy, by and at the same time, it opened the German Democratic Republic. In retrospect of the whole process of the Emerging of Weimar Constitution, politically, the first dispute was the adaption of the fundamental rights in the Constitution and then the several changes in the government drafts. In the end, the expansive version of "the father of the fundamental right to Konrad Beyerie" replaced the modest official version of "the father of the Constitution to Hugo PreuB ". The participations and opinions of the various political parties reflected the social and political views on the changes of significance and understanding for the fundamental rights. In academe, the second part of the Weimar Constitution was also a new field for the state law scholars, because the majority of the provisions could not be grasped by the concept of classical freedoms in 19th century. At that time, the "Struggle over methods and aims (Methoden- und Richtungsstreit)" for the State Law also contributed to the development of interpretations and theories of fundamental rights. These theories influenced the transformation of the fundamental right theory in the period of Federal Republic of West Germany 1949. However the unfortunate political conditions made all efforts from the making of the Constitution and Scholars in vain, just overnight in 1933 by the National Socialist party. |
