中文摘要 | 國際勞工組織(International Labor Organization,又稱ILO)對於勞動權益或勞動條件所為之公約,為普世認同之勞動基準。為因應全球化經濟所生變化,致勞動權益保障未能周延,國際勞工組織乃將基本人權中之自由權、平等權,與勞動者基本權之團結權、協商權有關之公約訂為「核心勞動基準」,以揭示該等權利之重要。我國現雖非為國際勞工組織之會員國,但為人類社會之一份子,亦應遵守國際之勞動基準,保障勞動者之基本權益。本文以國際勞工組織之核心勞動基準為基本標準,對應相關之勞動立法及行政上之實務見解,以檢視我國在勞動基本權之保障。以第29號強制勞動禁止公約,對應勞動基準法第五條及第四章工作時間、休息與休假相關立法與行政函釋,檢視我國之勞動自由。以第100號同工同酬公約及第111號歧視(就業與職業訓練)公約,對應就業服務法及性別工作平等法(原「男女工作平等法」)相關立法與行政函釋,檢視我國之勞動平等。以第87號結社自由及保護組織權公約與第98號團結權及團體交涉權公約,對應工會法相關立法與行政函釋,檢視我國之勞動團結。也以第98號團結權及團體交涉權公約,對應團體協約法相關立法與行政函釋,檢視我國之勞動協商。 |
英文摘要 | The labors rights and working conditions are mostly regulated by the conventions adopted by the International Labor Organization (hereinafter as ILO). Because of the globalization, and the consequent change, the labor rights are not protected sufficiently. ILO set up "Core Conventions" (to cope with this situation accordingly "Core Labor Standard") since Taiwan is the member of the International Society, it would be necessary comply with the Core Conventions not with standing its legal status. This article is intending to treat the core labor standards of ILO as the primary standard, corresponding to the labor legislation and the opinion of the administration in the practice, to review the basic human right of labor in Taiwan, and the Conventions concerning forced labors correspond to the article 5 and chapter 4 (Work Hours, Time off and Leave of Absence) of Labor Standard Act, so to review labor freedoms. And the convention concerning Equal Remuneration for Men and Women Workers for Work of Equal Value and Convention concerning Discrimination in Respect Employment and Occupation correspond to Employment Service Act and Gender Equality in Employment Act, to review labor equality. Freedom of Association and Protection of the Right to Organize Convention and Right to Organize and Collective Bargaining Convention correspond to Labor Union Law, to review the right to unite of labor. Right to Organize and collective Bargaining Convention correspond to Collective Agreement Law, to review the collective bargaining of labor. |
