中文摘要 | 依民法第482條規定「稱僱傭者,謂當事人約定,一方於一定或不定之期限內爲他方服勞務,他方給付報酬之契約。」,「報酬」是僱傭(勞動)契約的要件之一,勞基法第2條第3款進一步將「報酬」稱爲工資定義爲:「勞工因工作而獲得之報酬。包括工資、薪金及按計時、計日、計月、計件以現金或實物等方式給付之獎金、津貼及其他任何名義之經常性給與均屬之。」。勞工行政及司法實務對於勞基法工資定義要件究係「勞工因工作而獲得之報酬」或是「經常性給與」向來存有不同見解,各界對於經常性給與概念的由來、功能作用、理論價值亦少有探討,故本文針對工資定義規定所產生的相關爭議進行討論,並嘗試釐清經常性給與概念的功能作用及理論價值。 |
英文摘要 | According to the Civil Code, ”employment” is a contractual relationship between ”a party who furnishes labor” and ”another party who, in consideration of that labor having been furnished, pays a basic remuneration to the firs party”. Remuneration is one of the basic elements in labor contracts. Remuneration is more precisely defined in Labor Standards Law, which provides that ”Wage means the compensation which a worker receives for his work, including wages, salaries, bonuses, allowances, whether computed on an hourly, daily, monthly or piecework basis, whether payable in cash or in kind, and any other regular payments under whatever name.” The Labor Standards Law's definition of wage primarily clarifies the meaning of wage in various wage-protection provisions of the same Law. What is the requirement of definition of Wage in Labor Standards Law, ”compensation for worker's work” or ”concept of regular payments”? How to judge whether a payment falls under a Wage? There is different opinions between Administrative practice and jurisprudence. This paper is to research dispute problems arising from Wage Definition of Labor Standards Law and provide some useful ideas for interpretative and legislative basic design of Labor Standards Law's wage definition. |
