中文摘要 | 2002 年12 月7 日台北市政府公告實施「擬(修)訂臺北市萬華區大理街附近地區細部計畫案」,將台糖公司約0.66 公頃的住三用地變更為公園用地,而內政部為配合台北市政府無償取得該公園用地,核准變更台北市文山區博嘉段四小段410 地號等地,即透過都市計畫變更容積移轉,將台糖公司文山區土地由住宅區變更為商業區,作為對台糖公司之損失補償。本文以此為例,藉由財產權保障的觀點,剖析地方都市計畫政策形成過程中的弊病,並檢視我國現行都市計畫變更及容積移轉涉及人民權益損失補償之機制,進而剖析政策形成之妥適性,及對都市計畫變更與容積移轉之財產權保障作一評議與論述。研究發現,政府在進行都市開發時,以所謂的公眾壓力與公共利益,透過對於法令之特別解釋,以行政規範之手段,將國家應作為之事,轉嫁給另一地區居民,這樣的作為,就社會的公平性,及有限空間資源之合理使用,是有其爭議之處。 |
英文摘要 | On December 7, 2002, the Taipei City Government announced a new subdivision plan for the Dali Street Area in Taipei City’s Wanhua District. The new subdivision plan dramatically altered the zoning map, with a 0.66-hectare parcel of land owned by Taiwan Sugar Company (TSC) being transferred from residential use to public park use. The title of this parcel of land was subsequently transferred to the Taipei City Government, which rezoned another TSC-owned parcel of land from residential to commercial use in lieu of monetary compensation for the park land, thus using floor area ratio (FAR) transfer as a means of compensation. From the perspective of property rights protection, this study analyzes flaws in the policy formation process of local government urban planning, reviews Taiwan’s current urban plan alteration and FAR transfer compensation mechanisms, and examines the appropriateness of using FAR transfer to compensate impairment of property rights resulting from changes to urban plans. The study concludes that, when the government conducts urban development, acting in the name of public pressure and public interests, it resorts to special interpretations of the law and the use of administrative means to shift obligations that it should bear onto the residents of other districts. Such an approach gives rise to some controversy in terms of social fairness and the rational use of limited spatial resources. |
