中文摘要 | 國內寡占油品市場中僅有二大供油業者,臺灣中油股份有限公司與台塑石化股份有限公司每週調整油品(汽車與柴油)批售油價之行為,幾乎存在同步同幅調整批售油價之現象,探討此現象究竟是屬於寡占市場上之一致性行為或平行行為。公平會引用「一致性行為理論」,採認市場上各種間接證據,以檢視二大供油商客觀一致性之市場行為,推論其是否存在聯合合意,以判斷二大供油商有無聯合行為。本文先探討學理上與實務上對於一致性行為之見解;接著針對目前國內油品市場批售油價同步同幅調整之現象進行檢討與分析,討論實施浮動油價機制後,二大供油商每週調整批售油價有無涉及聯合行為之問題。 國內典型的寡占油品市場,二大供油商在高度重疊的地理市場,提供完全替代性的油品,調價資訊的快速傳遞與回應等,不論有無預告調價資訊或廠商之聯合調價之合意,國內批售油價之調整,依寡占市場之特性,油價調整之變化仍會長期趨於價格一致之結果,或許必須接受這個寡占油品市場的宿命。 |
英文摘要 | The purpose of this essay is to discuss the problem of the behavior of the same Oil-pricing between Chinese Petroleum Corp. and Formosa Petrochemical Corp. in the long-run Two big distributors in the domestic oligopoly oil market, once one adopt an oil-pricing strategy, the other react immediately and decide the same one, called conscious parallel conducts. Fair Trade Commission adopted the theory of concerted actions to distinguish concerted action and conscious parallel conduct, proving the existence of communications among undertaking by indirect evidence and inference from it and judging the cartel case in the oligopoly oil market. Whether providing the oil-ricing information in advance or not, the two big oil distributors will adjust the oil price to the same as soon as possible in the long run. Maybe, we should accept the predestination of the oligopoly oil market that two big oil distributors adopt the same pricing strategy for keeping the same oil price. |
