中文摘要 | 我國大學法第一條規定大學設立宗旨是「大學以研究學術,培育人才,提升文化,服務社會,促進國家發展為宗旨」,但是第四條第三項規定「各大學之發展方向及重點,由各校依國家需要及學校特色自行規劃,報經教育部核備後實施,並由教育部評鑑之」。究竟第一或第四條條文才是大學評鑑的根本目的,值得探討。筆者以為評鑑之範圍及內容必須附次於大學法的根本目的。 然而,我國「大學評鑑」是大學法直接授權教育部行使公權力,並不像歐美國家由民間團體自行舉辦評鑑,教育部組織「大學綜合評鑑規劃諮詢委員會」及「訪問評鑑委員會」,進行評鑑程序。雖然教育部屢屢對外聲稱屬試辦性質並期待於試辦累積經驗後發展一套完整的政策作法。但是評鑑結果產生,教育部將據之以如何?也成為眾所矚目的焦點。況且,各類大學因為設置主體不同,對國、公立或私立大學而言,評鑑結果意義可能不同,除具參考作用外,現階段作法是否僅屬行政法學上的事實行為?或有可能是行政指導?或竟是行政處分?疑義有待釐清。 本文即以行政法觀點,對「大學評鑑」提出幾點研究看法。最重要的結論是大學評鑑絕不能傷害學術自由與大學自治。但是對於提升學術與釐清大學自治,大學評鑑應不是全然沒有幫助。 |
英文摘要 | In our country, The article 1 of the University Act regulates "Thepurposes of University establishment is to research academics, educateelite, promote cultures growth, welfare society and pushes Nation development", but the article 4 of the University Act regulates "Theorientation and heavy points of development of All the Universities depends on the necessities of the state and schools characters, It should be enacted it after the approvals of the Ministry of Education and evaluated by them." and then what are the fundamental aims? Article 1 or 4 is the fundamental aims of "University Evaluations"? The Author believes the question of "University accreditation fundamental aims" is worthy of fully disscussion and the scope and contents of University Evaluations must be subsidiary to the University Evaluations fundamental aims. Even though, University Evaluations in our country, the Ministry of Educations authorized the University Evaluations powers is delegated directly by the University Act, It is different from that University accreditation in European countries and America. American University accreditation are taken place by civic groups, the Ministry of Eduations organized "the University Syndicated Evaluations Plan and Consultant Council" and "the Visiting and Evaluation Committee", to execute evaluation procedure. Although the Ministry of Education declared that the University Evaluations plans of 1997 are on trial, and excepted that after on trial can accumulate experiences and to develop a set of aggregated policies. Although, according to university evaluation results, What Ministry of Education can do? The Ministry of Education will take "the University Syndicated Evaluations" results as what? It would be the focus of the mass media. All kinds of universities have different founding methods. To the State or public or private university, the implied meansingness of evaluations results are posssibly different. The author thinks that the results of university evaluation except referential usefullness, might be executive directives? or executive order? or executive command? The questions must be clarified and resolved. The most important conclusion is that University Evaluations can't hurt the academic freedom and university autonomy. but University Evaluations maybe do somothing helpful to promote academic level and Clarity university autonomy. |
