中文摘要 | 本文之目的,是要對規範勞動派遣之國際勞動基準,做一全面之回顧與評析。除序後言結語外,全文共分三大部分:第一部份簡要敘述勞動派遣在近期之興起情形及所衍生之問題,並說明各國因應之相關立法情形。第二部份以三個階段為期,分析國際勞工組織建構勞動派遣國際基準規範之演進過程,主要是以它在一九三三年所通過之「收費就業機構公約」又及在一九四九年所通過之「收費就業機構(修正)公約」為探討重點,說明該組識在過去六十年來對收費勞務仲介立場之演進過程。第三部份則是對該組織在前年所通過「私營就業機構公約」之制定背景、重要內容及可能產生之影響等事項,做一綜合性之評析。 |
英文摘要 | The purpose of this paper is to make an over-all account of the historical backgrounds, current situations and future prospective of international labor standards governing dispatch employment, which has become a new trend in recent years. Aside from introductory and concluding remarks, the whole paper can be divided into three sections. First, it briefly describes the reasons for the surge of dispatch employment as employment flexibility has become a catchword currently and the consequences this atypical employment relationship has caused. In addition, new related legislation adopted by several countries to cope with this new issue are also examined. Secondly, it uses three stages to analyze the evolutionary process of the International Labor Organization (ILO) to set up international labor standards for dispatch employment in the past sixty years, and two related connections, i.e., the Fee-charging Employment (Revised) Conventions of 1949 are discussed respectively. Finally, the paper makes a critical assessment of the backgrounds, main contents and possible impacts of the Private Employment Agencies Convention which was adopted by the ILO in 1997. |
