中文摘要 | 考試制度是我國已沿襲千年的傳統文化之一,而以行政、立法、司法、考試與監察等五權獨立,進而架構出的五權憲政體制更為全世界獨一無二的憲政制度。然而,雖然我國憲法將考試權自行政權中分出,並賦予其獨立地位,但是多年來,學界對於考試權所應包含的範圍卻始終迭有爭議,尤其是在考試權是否應該涵括人事行政權這一部份,更是眾說紛紜。另在我國實際的憲政運作中,雖然《中華民國憲法》賦予考試院極為完整的、且包括人事行政權在內的考試權,不過由於該憲法公佈不久之後即被凍結,改以施行《動員戡亂時期臨時條款》,因此我國憲法本文所賦予考試院之權限始終無法落實。依照我國的憲政體制,考試權到底該如何界定?人事行政權若如憲法本文劃歸考試院掌理是否合理?修憲前後,考試權的範圍有何變動?以上皆為本文所探討的重心所在。 |
英文摘要 | The examination system is one of the features of Chinese traditional culture, and Five-Power Constitutional System is the unique one in the world. According to the Constitution of ROC, the examination power is an independent power, and the Examination Yuan is the highest organization which manage personnel system of government. However, when Central Personnel Administration was found since 1967, the limits of both functions and powers are incompatible. The inconsistency between Examination Yuan and Central Personnel Administration lead to a great dispute in the academics. This paper’s core is to analyze the scope of examination power, and to research the change of examination power after amendment of Constitution. |
