中文摘要 | 勞動三法於本次立法院於九十四年一月二十一日結束之會期經過幾度協商,從過關希望濃厚到最後闖關失敗,勞動三法其實修法之倡議已久,其中有關勞資爭議處理法行政院勞委會於九十一年間便提具理由,認爲勞資爭議處理法自民國七十七年六月二十七日條正施行迄今,已歷十多年,現今國內政治、經濟、社會狀況已多有變更,現行法己難適應,爲健全勞資關係法制,故配合工會法、圑體協約法之修正,針對目前缺失考量未來發展狀況,參酌外國立法例,本於勞資爭議之處理應秉誠信、自主精神,勞資爭議不宜影響社會之秩序及公共利益等原則,擬具勞資爭議處理法修正草案,在關於爭議期間之上資危險負擔問題,則是增訂勞資爭議處理法草案第五十二條:「爭議行爲期間,勞工未爲勞務之提供時,雇主得拒絕給付工資。爭議期間勞工所爲勞務之提供,爲雇主受領者,雇主應給付工資,但其勞務之提供,於雇主無實益經雇主拒絕受領者,該勞工無工資請求權。」,以該條爲處理之基準。此種處理方式是否爲一可行的解決之道,是合仍有其他處理勞資爭議期間工資危險負擔問題之可能性,筆者將於本文中始自羅馬法、市民法,導引到憲法、民法及集體勞動法議題之討論,並對德國之處理方式加以論述,最後再評釋草案中處環方式是否可行。 |
英文摘要 | For the past session which ended 21, Jan. 2004 there were over 100 bills inclusive the Amendment of the Settlement or Labor Disputes Law waiting to be taken off the legislative agenda But only the number of 57 bills not inclusive the Amendment of the Settlement of Labor Disputes Law approved by the legislators during the past session. The wage's problem during the period when labor disputes is real difficult to find a fair solution. The Article 52 of the draft amendment of the Settlement of Labor Disputes Law is one of the way to solute this problem but not an only way This Study tries to analyze The Article 52 of the draft amendment of the Settlement of Labor Disputes Law. This Study first aims to introduce and analyze the German solution of the wage's problem during the period when labor disputes for its original thought principal goal and major content Then this Study will compare the German system with the Taiwan's system In the end, this Study is going to point out that Taiwan should fine its own way for its next generation the wage's system during the period when labor disputes. |
