中文摘要 | 動產因附合而為不動產之重要成分者,依民法第八一一條之規定,由不動產所有人取得動產所有權。動產所有權人於具備本條所規定之要件,而當然喪失其所有權者,不動產所有權人之權利因而擴張及於該動產,此乃法定動產物權變動之事由。由於此一規定,對於當事人間權利義務之影響甚大,因而,自須探究究其構成要件為何?此外,立法者在面臨動產與不動產附合之問題時,就動產所有權人與不動產所有權人間之財產權歸屬的衝突而為解決時,其所以選擇犧牲動產所有權人,而保護不動產所有權人,究竟係本於何種利益衡量標準以為判斷?對於因附合之關係而喪失其權利之人,是否有適當之救濟方式?物權編修正草案就此法律效果所為相關之修正規定,是否足以影響當事人間之權利義務關係?均有待本文為進一步之探究。 |
英文摘要 | Due to incorporation, that personalty has become an essential ingredient of realty should be decided ín accordance with Article 811 of Civil Code, wherein it stipulates that title holder of real property will obtain such ownership of personal property. If all essential terms accords to the said Article's requirements, such holder's ownership of personal property will be lost; while holder' s ownership of real property will expand toward such persona1ty-a legal basis of alteration of personalty on rights of thing. The above-referred rule will seriously affect the rights and obligations between the parties involved. Therefore, it is critical to explore what the said essential elements are? In addition, the policy ground as well as its evaluation standard as faced by legislature while dealing with the issue of incorporation of personalty to realty ought to be considered; and the reasons why holder of personal property is sacrificed, in order to protect the owner of real estate, during conflicts of the title or ownership arguments there between. What are the adequate remedies made available to those suffered the loss of ownership or rights due to such relationship of incorporation? Are there provisions under current amendment to the Chapter of Rights of Thing that will affect such rights and obligations of the parties? These issues deserve further discussions in this paper. |
