中文摘要 | 表演人權利之保護與科技的發展有密切的關係,但表演人在法律上權利之爭取比一般著作人不順利,其反對力量主要來自表演人所依附之強大的影音娛樂事業。本文從表演人保護之起源,經由國際上著作人權利法系與著作權法系之不同概念,並細述羅馬公約、TRIPS及WPPT等國際公約之發展,分析我國現行著作權關於表演人權利之保護,並對著作權法提出立法建議。 |
英文摘要 | There is a close relationship between the protection of performer's rights and technological development. Unlike authors, the performers have to be confronted with enormous opposition from entertainment industries which they are fully depending on. This article is going to introduce the origin of performer's protection, describe the development of international conventions concerning the protection of performer's rights in details, and analyze the current relevant provisions in ROC which Copyright Law through the comparison of different ideas between Copyright System and Author's Right System. In the final, there is a proposal to suggest the amendment of the Copyright law. |
