中文摘要 | 我國海商法學者對於運送章所採之運送人責任標準,多認為係採「過失責任主義」。惟,由比較法制觀察,英美普通法與海牙規則對於運送人責任之標準,所採者並非過失責任主義。我國學者將海商法運送章解釋為採過失責任主義,不僅對於運送人堪航能力義務與貨物照管義務之詮釋迥異於其他繼受海牙規則之國家,對於整個運送人責任體系而言,解釋上亦有不通之處。本文主張回歸海牙規則所採之「船貨雙方攻防順序」,而不採過失責任主義。 |
英文摘要 | Most of the maritime law scholars adopt "the principle of liability with fault" as the standard of the ocean carriers' liability in Taiwan. But, considering the concept of comparative law, we find that the liability of the ocean carriers is not ruled by such principle in the common law and the Hague Rules. If the adoption of such principle were accepted, the explanation of the obligation about seaworthiness and cargo management of the ocean carriers in Taiwan would much differ from the explanation of the other countries that have acceded to the Hague Rules. Subsequently, the explanation about the standard of the ocean carriers' liability should be in confusion. In this essay, we don't think that such principle should be adopted, and "the order of proof in marine cargo claims" has to replace such principle. |
