中文摘要 | 土地開發是一複雜的投資過程,且包括具不同背景的參與者。目前對該過程的了解仍不十分清楚,也沒有一個適當的模式能全然描述為何開發者欲從事土地開發,以及其如何進行開發。視土地開發過程為財產權的操作,以期在公共領域內獲取財產,本文擬提出一概念性的土地開發行為模式,作為了解該過程的基礎架構。財產權在此廣義地定義為在實際的交易行為中,土地的財產權並不能清楚地劃分。因此,有些財產權便存留在公共領域中,而開發者便致力於這些財產權的獲取。這個概念性模式提供有關於開發者為何及如何從事土地開發的一些重要理念。本文舉一例子說明土地管制對開發者行為的影響,以解釋該模式如何可應用來闡述土地政策與土地開發行為關係,藉由以交易成本為基礎的規劃理論,結合以本模式土地規劃及組織的解釋,期能對規劃的了解提出未來的研究方向與隱喻。本模式十分具有軔性,不同區域的土地開發案例可在本模式的共同架構下加以比較。 |
英文摘要 | Land Development is a complex investment process involving various participants with diversified backgrounds. The process is poorly understood because there is no appropriate model that fully characterizes why and how developers engage in land development. Viewing the land development process as manipulation of property rights in order to acquire such rights in the public domain, we provide a conceptual model of land development as the underlying framework for understanding the process. Property rights are defined here in a broad sense in that the basic observation about such rights is the impossibility of complete delineation of such rights in reality. Some property rights are, therefore, left in the public domain from which developers are motivated to acquire such rights. This conceptual model provides significant insights into why and how developers proceed in land development. An example of effects of land control is provided to show how the model can be used to interpret the developer's behavioral response to such control. Implications on land planning and the associated organizations can be gained through such interpretation in combination with a transaction cost based planning theory. The model is sufficiently robust that land development cases in different regions can be compared under the common framework. |
