中文摘要 | 有關教育基本原理與原則方面的規範通常見諸於一國之教育基本法,透過這些法律的制定,使教育的本質、教育的目的、教育的實施方針、教育的組織、教育的活動、教育的主體等方面有原則的釐清與規劃,作為整體教育實施的總綱領,並成為各項中央與地方教育法規的立法基礎。 海峽兩岸的中國人分別於一九九五年三月及一九九九年六月公佈實施教育的基本法律,中國大陸稱為教育法,我國則稱為教育基本法。這兩部法律各自對教育方面根本性與全局性的問題做出規範,是雙方教育發展方向的基本規定,也是尋找雙方教育基本問題異同的一個有價值的題材。 本文將從雙方教育基本法的立法機關、立法動機、立法過程、法制基礎、條文結構、立法指導思想等方面進行初步比較,以尋找兩岸雙方教育基本上的差異及問題,作為兩岸教育比較研究的參考。 |
英文摘要 | Fundamental principles of education are usually specified in a country's constitution or in its basic law of education. Through the establishment of these laws, a country sets the general guidelines for educational essence, purpose, practice, system of organization, type of activities and the involvement of its members. Under these fundamentals other education-related bylaws of the central and local governments can be integrated. The Basic Education Laws of Mainland China and of Taiwan were issued in March of 1995, and June of 1999, respectively. They each set the rules and regulations for the practice of education in the most fundamental and comprehensive way. They indicate the direction of educational development and also provide valuable material for comparing issues regarding education in these two countries. By comparing the legalities, motive, process, foundation, structure, and guidelines of these two laws, this study intends to discover the basic differences in education between Mainland China and Taiwan. This will also provide the reference for the comparsion of the educational systems between Taiwan and Mainland China. |
