| 中文摘要 | 新加坡航空(SQ006班機)於去(89)年10月31日發生在桃園中正國際機場的失事,涉及國內外調查機關、司法機關、國際組織、罹難者家屬及航空業者之間的尖銳利益衝突,凸顯了我國(作為失事調查主導國家)相關法制的國內及國際之重要性。作者為探尋我國法制對於各個利益主體其主張所設之界限,於本文先行初步討論我國民用航空器事故調查法制之重整要點,再以航空器事故調查機關及司法機關的平行調查概念為重點,討論芝加哥國際民用航空公約對於航空器事故調查之相關條文暨其第13號附約之相關規定。為求進一步瞭解國際法規在各國落實之程度,本文亦將討論某些飛安成績良好國家(歐盟、德國、英國、美國及加拿大)的航空器事故調查制度,以作為與我國制度比較之基礎。作者將嘗試由各國法制中歸納出一些原則,作為評量我國法制利弊之標準,以及我國未來進一步修改或制定航空器事故調查法律之指南。 |
| 英文摘要 | The SQ006 accident which occurred on 31 October 2000 in the CKS Airport (Taiwan) has engaged the conflicting interests pertaining to ROC and foreign aircraft accident investigation agencies, ROC and foreign judicial authorities, airline pilots association, families of the victims, and airline company. Such clashes of interests have demonstrated the importance of the role that the ROC relevant civil aviation law and regulation can play in both domestic and international arena. In order to identify the boundary of jurisdiction for all the relevant Taiwan authorities under the ROC law and regulation, the author will begin with a brief description on the recent reformation of the relevant provisions of ROC Civil Aviation Law and the subsidiary regulation thereto. In the light of the concept of parallel investigation between accident investigation agency and judicial authorities, the author will discuss the relevant provisions of the Chicago Convention on International Civil Aviation and the Annex 13 thereto. Relevant International Standards and Recommended Practices will be identified, discussed, and related to the corresponding laws and regulations of some ICAO Member States with better air safety records, such as Germany, United Kingdom, the United States and Canada. The relevant laws of these States as well as EU regulation will be compared and analyzed to enable the author to induce from these some important and general principles. These principles will be used as a yardstick to evaluate the newly amended and promulgated ROC law and regulation in this regard and to serve as the guidance for the ROC Government to further amend or enact its relevant law and regulation in the future |
