中文摘要 | 邁入二十一世紀之際,為了迎接新世紀全球性的政治、經濟、文化與科技的快速變遷,世界各主要國家紛紛進行一連串的實質教育改革,期能藉由教育品質的提高,來提升國家在世界的競爭力。我國身處地球村之一員,自然也在世界各國改革的共同重要趨勢有所回應。從民國82年開始逐漸高張的教改呼聲,到四一○教改運動(民83),到教育部回應民間的呼聲,宣布民國83年為「教育改革年」,發布〈中華民國教育報告書〉(民84),到行政院教育改革審議委員會成立,定期地發布〈教育改革諮議報告書〉(民84-85),到民間四一○教育改造聯盟的〈民間教育改革藍圖〉(民85)、…到「教育改革行動方案」(民87)、到〈教育基本法〉(民88)通過立法程序,一連串教育改革活動的事實,正反映出臺灣世紀末的教育改革乃是經由社會各團體間不斷的溝通、對話、協商、調解的歷程,彼此達成共識,並進而實踐共識的民主化過程。從這整個過程,我們看到臺灣逐漸掙脫威權時代束縛,走向另一個新紀元的可能性,而〈教育基本法〉正為未來的改革行動提供引導的方向。是故,〈教育基本法〉又被譽稱為是「教育準憲法」,以奠定我國未來教育發展的基礎,補充「憲法」對教育原則性規範的不足,乃為教育的各相關工作者所必須瞭解。因此,本文將針對〈教育基本法〉之主要理念進行分析,並且從歷史的角度借鏡西方教育改革運動的經驗,以供參考。 |
英文摘要 | The educational law in the development of education system is an important indicator during the history of education. Traditionally, the education system was believed to be beneficial to individuals, especially to society. For the necessity of improving the educational circumstances in Taiwan, the Law of Education had been established in Legislative Yuan in 1999. It was based on the new opinions, which were proposed by lots of people or groups concerned the educational development in Taiwan. It was hoped the new law would be the principle to conduct Taiwan's education into the new century. The purposes of the law were not only to be the source of social justice, but also to be the intention of fulfilling self-actualization for individuals. The aims of this review are to expound the main ideas of the Law of Education and to inspect the law is fit or not from the view of philosophical epistemology. It is hoped that this study will offer a new direction to consider the educational reform in Taiwan. |
