英文摘要 | There is conflict between property rights and development regulation, especially regulation for controlling the timing, location, pace, amount, and quality of development. Many development interests and some landowners denounce environmental and land use regulation as an unwarranted or illegal intrusion of their property rights (Meyers, 1997:22). In recent years, Taiwan has adopted development control-related programs to influence land use and development. We believe that the adoption of innovative development control techniques can resolve or at least release the issues of urban growth and land development in Taiwan. However, they may also create issues such as illegal intrusion of property rights, or providing negative impacts on private sectors. Therefore, the purpose of this paper is to explore the issues of adopting development control-related programs, especially based on American suit cases and experiences in order to provide references for Taiwan. First, it discusses the theoretical background of governmental intervention to deal with development issues. Second, it introduces the development control-related programs in addition to zoning. Third, it explores the impacts of development control-related programs on legal challenges and private sectors. Finally, this paper provides conclusions and suggestions. |
