中文摘要 | 企業組織,自工業革命及近代資本主義制度發達後,企業或工廠已非單純家族性 手工業,而是結合了人力、資金、物料、機器和市場等組成要素之集合多數人一起共同工作 的團體;因此為順利達成企業營業目標,制定企業內全體組成員應共同遵循的服務或工作紀 律、或行為準則,使組成員行為能劃一性、統一化,和諧達成目標,此項規則或準則是必要 的,此即工作規則之由來。 在實施「勞動基準法」之國家,「工作規則」之制定由雇主一方片面決定,勞基法再規定一 定成立生效之程序,藉以保護勞工,然勞動契約雖具「從屬性」,但其本質仍係民法上僱傭 契約,當事人間理論上應立於平等地位,何以雇主得一方片面制定工作規則,且實際上工作 規則內容依我國勞基法七十條規定已完全融入勞動契約,而此片面制成工作規則卻能拘束勞 工,則工作規則之法律性質究為何﹖透過本文探討,希望有助行政及司法機關來解決因「工 作規則」所生勞資爭議。 |
英文摘要 | Works Rule or Employment of rule is a necessity of modern factor and industry. The rules are created by employer without labor's consent to force labor obey. Although it makes factor's production promotion and easy to control labor discipline, but it may against labor right or benefit especially without labor's consent to make work condition unbeneficially chang. In adittion according to labor standard law artical-70, the contents of Work Rule should be same as Work Contract that be made by both parties Empolymer and Employmee, but Work Rule and Work Contract are total different in theory. Why employer could make Work Rule by themselves without labor's agreement and therefore impose a obligation on worker just like as the effect of Work Contract? Is it reasonable? Through the reaserch of Works Rule wish to give a answer to help dispute resolution. |
