中文摘要 | 於九十八年一月十二日三讀通過民法物權通則章及所有權章修法,此次通過之民法物權編於通則章適度緩和物權法定主義之僵化,另亦擴大不動產物權宣示登記之原因,以及增訂不動產物權依法登記之效力及對因信賴登記而為物權變動之善意第三人之保障規定,修正拋棄物權之要件及其方式。於所有權章則是關於動產所有權、不動產所有權、共有等皆多有修訂。而本文著重探討2009年1月12日通過之物權法中,與時效取得相關之爭議。財產權為憲法明定應予保障,惟時效取得制度乃國家透過立法行為重新調整所有權人及占有人間之財產權關係,故時效取得制度之剝奪財產權手段,是否違背憲法保障財產權之精神,殊值研究。本文首先針對時效取得之定義以及本制度之存廢論點提出分析,再針對修法前後時效取得規範作出比較,俾利本文最後對此次修法加以分析及提出建議,期能對我國物權法時效取得制度有所助益。 |
英文摘要 | Acquisitive prescription is a method of acquiring property by meeting statutory requirements of continuous possession, which vary by state, and it is the constitutional protection ,too. But it would bring huge impact to the owner's property.The purpose of this study is to discuss some issues on the prescriptive system in Taiwan, especially the issues related to the regulation of articles from 769 to 772 of Civil Law which is amended recently, so as to investigate and analyze the effects of the amended civil law, and bring up the directions for the future amendment of the acquisitive prescription. |
