中文摘要 | 我國教師法第29條為保障教師權益,特設教師申訴之救濟程序,教育部並依教師法第29條第2項之授權,另行訂定「教師申訴評議委員會組織及評議準則」,以作為教師申訴制度運作之法規依據。但因上開準則立法簡陋,僅有少數條文,對於申訴之重要事項諸如教師得提起申訴之標的範圍、教師提起之申訴與訴願問之關聯性等等,並未明定於教師法或未於教師法設有明確授權以資訂定法規命令而予以規範,自不足以因應實務運作之需要,致使教師申訴制度在實際運作時,不僅窒礙難行,對於教師權益保障之功能亦無從充分發揮,自有加以探討之必要。本文因限於篇幅,主要擬以申訴制度之功能及其重要性、申訴之標的及其適用之程序、申訴與訴願之關聯性及其改進等為研究範圍。 |
英文摘要 | In order to safeguard the right of teachers, Article 29 of Teachers Act, is hereby enacted specifying the procedure of appealing. And Ministry of Education also establishes Regulation of the Organization and Deliberation of The Teachers Appeal Review Committee according to Article 29, Paragraph 2, as the legal basis of the appealing system. The regulation mentioned above is rough, and there are just a few regulations. There are no specific rules indicating the essential factors such as appealing scope or the relevance between appealing and administrative appeal. The regulation does not meet the actual needs. The appealing system is therefore impractical. There are still a lot to be deliberated. This study mainly discusses the function, importance, target, procedure, the relevance between appealing and administrative appeal and the improvement of appealing. |
