中文摘要 | 弊端揭發人(whistle-blower)是對組織不法情事進行舉發之內部成員,因為其熟悉機關內部且較易取得弊端資訊的特性,因此被認為是防止弊端最有效且也是最後之防線。然而弊端揭發人基於道德勇氣檢舉不法,卻經常受到機關鋪天蓋地而來的各種手段加以報復,因而我國匿名檢舉之比例高居不下。我國現行對揭弊人保護的機制不夠完善,弊端揭發相關的權責分散,以及弊端揭發人相關法律條文模糊,使檢舉管道、保護與保密規定晦暗不明,讓揭弊者心生退卻。建立一套完善的弊端揭發人保護制度可以有效鼓勵更多揭弊人士,以具名的方式和正式的揭弊途徑,進行不法之檢舉,進而改善公部門貪污腐化之現象,重新建立起人民對政府之信心。據此,本文主要的重點在於:一、說明弊端揭發人制度的緣起,以及分析弊端揭發的風險與效益,二、我國相關機制的評析,三、實證訪談結果的呈現,以及最後提出結論與建議。 |
英文摘要 | Whistle-Blower is the person in the internal organization and exposes the illegal affairs by free will. Since 1978 the Whistle-Blower institution had been the most effective way, and the last defense line to pursuit the merit system in America's working experience. But after exposing the illegal affairs, Whistle-Blowers are often attacked and revenged , such like reducing salary or official ranking ,maybe it's the reason that the ratio of anonymous exposing case always keep high. The protection of Whistle-Blower now in Taiwan hadn't been completely enough, because the authorities disperse to different institutions, and the laws of Whistle-Blower institution are unclear. These factors make civil service fear to expose illegal affairs in Taiwan. By building a good Whistle-Blowers protection system, it can powerfully inspire more civic service to disclose illegal affairs in the formal approaches, correct the corrupt condition, improve the imagination of the public department, and finally gain the public trust form the people in Taiwan. |
