中文摘要 | 兩性平等法已於民國100年1月5日公佈施行,有鑑於我國對於性別平權之觀念日益進步,相較於早期之性騷擾定義亦漸漸轉換,由僅限於異性之範疇慢慢轉換至同性間也成就;從前以較狹義的定義到現今之使他人感受到(包含視覺及聽覺等)侵害即為已足,其對日常生活的重要程度可見一斑。我國相關於性別平等之案件,主要是由性別平等教育法、性別工作平等法及性騷擾防治法為適用(以下簡稱性平三法),性平三法之適用,大略採以身分關係作為其分類方式。示例而言,通常性別平等案件中關係如為師長對學生、學生對學生或為學生對師長,只須相對人一方為學生者,即是屬於性別教育平等法之適用範圍;而若其是屬於職場關係中的上司之於下屬,或下屬之於上司則皆屬於性別工作平等法之適用;最後如非屬上述兩法所管轄之案件,則屬於性騷擾防治法之範疇。 |
英文摘要 | Act of Gender Equality has become effective since J anuar y 5, 2011. In Taiwan, people’s t hought on gender equality enhanced gradually; accordingly, the definition of sexual harassment evolved from being limited between heterosexual relationship to homosexual one included, and from a narrow idea to the feel of being assaulted counted. In Taiwan, gender equality laws consist of Gender Equity Education Act , Act of Gender Equality in Employment, and Sexual Harassment Prevention Act. In general, the 3 acts regulated their own role relations in different situations. For example, if one part of the relationship involved the student , either the relations between a teacher and a student or between students, falls in the scope of Gender Equity Education Act. The relationship in work place, between a supervisor and a subordinate, will apply Act of Gender Equality in Employment . Cases not ruled by above 2 acts are the jurisdiction of Sexual Harassment Prevent ion Act . |
