中文摘要 | 自從司法院大法官作出釋字第649 號解釋後,2011 年10 月31 日起,「按摩業」不再是視障者的專業,此一違憲宣告,勢必對視障者的工作權與生存權造成重大衝擊。因此,本文的研究目的,一方面擬檢視大法官釋字第649號解釋的立論基礎;另一方面擬探討政府對視覺障礙者所提供的就業輔導訓練與措施是否有效落實,以及能否提升視覺障礙者的就業能力。 本文檢視大法官釋字第649號解釋的立論基礎,發現大法官審查方式有三大重點值得商榷,其一是為何同一號解釋,對平等權和工作權的審查標準居然不一致。其二是從憲法保障弱勢族群的意旨出發,對於「優惠性差別待遇」措施,大法官宜採寬鬆的審查標準。其三為涉及職業自由與視障者生存權衝突時,能就視障者生存權加以優先考量。 其次,雖然中央與地方政府因應第649 號解釋案已推出許多協助視障者就業的措施,但無論在按摩業的職業規範及其養成體系、養成教育階段促進措施及就業輔導階段促進措施等方面,仍值得政府繼續努力促成,始能進一步落實保障視障者的權益。為根本解決視障者的就業問題,本文建議除了修訂適當的保障法規外,其實更須政府、學校、企業及社會各界,從養成教育、職業訓練及就業服務等全面性考量,培育及增強視障者的專業形象和就業能力,以實質保障其工作權益,如此始能減低釋字第649 號解釋對視障者的衝擊,進而落實憲法保障弱勢族群的意旨。 |
英文摘要 | Since the Grand Justices of the Judicial Yuan made Number 649 Interpretation, as of October 31, 2011, Massage business has no longer been the proprietary profession for the visually- impaired. This unconstitutional declaration must cause serious impact on the rights of work and existence of the visually-impaired. Therefore, the purpose of this research is to on the one hand review the rationale of Number 649 interpretation, and on the other hand examine whether the employment placement training is effectively carried out to raise the ability of the visually-impaired for obtaining jobs. After reviewing the rationale of Number 649 interpretation, there are three parts of the reasoning basis worth considering. First of all, why are different judicial review standards applied to the rights of equal protection and work respectively; secondly, from the Constitutional intent to safeguard the disadvantaged, there should be a more lenient judicial review standard for the “preference treatment”; thirdly, while there is a conflict between the freedom of occupation and the right of existence of the visually-impaired, the latter’s right should be given a favorable consideration. Moreover, although the central and local governments have initiated the measures to cope with Number 649 Interpretation to assist the visually-impaired in the job market, in order to implement the guarantee of the visually-impaired, the government needs to put more efforts to accomplish the vocational norms and breeding system for the massage business and materialize the employment placement. In order to reduce the adverse impact of Number 649 Interpretation and strengthen the professional image and ability of the visually-impaired to practice the Constitutional intent to ensure the disadvantaged, the article suggests that except amending relevant regulations, more works have to be done through the attention of the governments, schools, enterprises, and disciplines of the society in terms of the maturing of breeding education, vocational training and employment service. |
