中文摘要 | 近二十年來之經濟蓬勃發展,也促成休閒活動之提升。根據交通部觀光局的統計,在九十七年出國人次已達八百四十六萬人次,而出國旅遊方式,則有91.5是委託旅行社辦理。故委託旅行社所提供旅遊服務之品質,必成為雙方旅遊契約糾紛中的爭執重點。依我國民法第五一四條之六的規定,旅遊營業人對於其提供旅遊服務,應使其具備通常之價值及約定之品質,是所謂負瑕疵擔保責任也。筆者雖經常出國旅遊,但也參加過當地旅行團多次,也與國外觀光客閒聊,交換旅遊服務心得,深知旅遊品質的面貌一二。故對有關旅遊之品質問題,實有很多討論的空間。因此,本文以旅程之安排、交通之提供、旅館餐廳、領隊及導遊及其他等方面來論述,並就我國旅行業品保協會之有關旅遊糾紛案例及我國地院判決案例做一綜合歸納探討,期有助於我國人未來旅遊時的品質要求提高,同時也期盼旅行業者能自我鞭策服務品質的改善,最終達到雙贏的理想境界。 |
英文摘要 | In the last twenty years, the vigorous development of economic sector has pushed forward the development of leisure activities. According to the statistics from Taiwan’s Tourism Bureau, the number of trips taken by citizens has already reached 8,460,000, and 91.5% of citizens have authorized travel agencies to handle their travel arrangements. Accordingly, the service quality provided by travel agencies has already become the main issue of the tourist contract dispute. According to article 514-6 of Taiwan’s Civil Code, the travel service provided by the tourist agency shall have ordinary value and the agreed qualities, which is the guarantee liability on defects of object. From the author’s personal foreign travel experience and the chat with foreign tourists about tourism service, the author found that there are many issues related to the tourism service quality worth discussing. This article discusses travel arrangement, transportation, restaurant, hotel, tourist guide and other issues in the following chapters. Furthermore, This article provides the case studies in tourism dispute from Travel Quality Assurance Association and Taiwan District Court. In order to achieve a win-win situation for both consumers and tourism agencies, the author hope to use this article to develop the consumer’s strong demand for quality tourism while encourage the tourism agencies to self-improve their service as well. |
