中文摘要 | 我國現行公務人員退休法制雖然改變了以往退休金給與的機制,也透過階段式退休理念的架構,規範了兼顧個人生涯規劃的退休機制,但一則由於設計規劃當時的過度樂觀;二則忽略了「公務人員對於自己的退休生活規劃,其實也存有好還要更好」的安逸心理,以至於現行制度運作十三年來,出現了諸多亟待改善的問題。 因此,本文係在體察現行退休法制施行十餘年後所現的問題,並參酌世界先進國家近些年在退休制度所進行的改革趨勢之後,本於嶄新的思維,就「應守的原則」及「可變的措施」等兩個面向,並秉持「落實實質分配正義」、「結合社會安全政策」及「維繫永業文官價值」的基本信念,從「退休政策」、「退休給與機制」及「退休金準備責任」等機制,深入探究,進而研擬若干退休法制改革的構想,俾期確保退休人員經濟安全,促進人力資源之運用效益,以及提升國家競爭力與政府施政績效。 綜而言之,當我們在檢討現行公務人員退休法制的種種,進而體察世界各國致力於其退休法制的改革之際,我們其實是該拋棄傳統線性思考的框架,本於嶄新的思維,認清現階段的客觀環境,並藉由理性思辨之後,勇於研擬出具有前瞻而可行的改革方案,俾有助於自由安全社會的建構。 |
英文摘要 | The current Retirement Code of Civil Servant in our country not only changed the mechanism of preexist pension payments, but also regulated the individual career planning. Since the Retirement Code has enforced for 13 years, there are many problems remain to be solved, which result from the over-optimism when the Retirement Code was designed and ignored the fact that “all civil servants incline to pursue a better life after retirement”. Through the comprehension of these problems we face nowadays, this paper tries to adopt foreign reformative experiences of retirement system. In terms of insistency and changeability, this paper based on the beliefs of “fulfill the allocation justice”, “combine retirement system with social security policies”, “maintain the value of permanent civil service”, and try to discuss these issues from different angles, such as “retirement policy”, “retirement benefits mechanism”, and “accumulative duties for retirement benefits”. Meanwhile, we proposed some conception of the retirement reformation to ensure the economic security of retirees, promote the effectiveness of human resources operation, and improve the competitiveness of government. Altogether, we should think outside the box when we examine the current Retirement Code in Taiwan and retirement reformation in other countries. In addition, we want to formulate the feasible projects which can construct a society with freedom and security by way of recognized the present objective situation and rational thinking. |
