中文摘要 | 醞釀許久,為眾多法律人密切關注的特種考試司法官考試及專門職業及技術人員高等考試律師考試(以下分別簡稱司法官考試、律師考試)新制,終於在民國一百年實施;由於新制之內容、設計,與行之有年的司法官考試、律師考試舊制相較,有相當幅度之差異,因之,關係自身前程之萬千應考人理當設法瞭解新制,並積極準備應試;此外,培育法律人的高等學府,以及關心法學教育人士,亦莫不密切關注新制之內容、設計與實施。 此次司法官考試、律師考試新制之推出,事前經多方研究構思、激烈論辯、反覆調整,歷十餘載,終告底定,亦經過考選部廣泛宣導以消除誤會,增進理解;無論其實施能否令各方皆滿意,畢竟屬「謀定而後動」之舉,仍需要經過實際執行,以客觀及科學態度與方法,檢討其利弊、得失,從考試掄才目標達成之角度著眼,探究新制考試之信度與效度後,再行籌謀下一階段考試新制之調整。 本文經由簡介司法官考試、律師考試新制之考試階段、考試科目、占分比例、通過標準及新制之特色等項,回顧長期遭扭曲之法學教育及其成因,並觀察考試新制對於法學教育及應考人之衝擊何在,嘗試持平探討法學教育當如何因應司法官律師考試新制,最終提出法學教育因應考試新制的治標與治本的興革之道供參。 |
英文摘要 | The new system re Judiciary Exam and Bar Exam is finally taken into effect in year 2011 after long time deliberation and wide discussions. Given the fact that the scheme and design of the new system are quite different from those of the old one, those who intend to take the Judiciary Exam and/or Bar Exam, as well as the law schools, are eager to learn the scheme and design of the new system, and are concerned about its implementation which would surely cause certain impacts on the contemporary legal education in Taiwan. After overall researches, schemes, and deliberations, together with repeated debates and drafts that followed, it takes almost two decades to have finalized the new system re Judiciary Exam and Bar Exam and to have it implemented in year 2011. The Ministry of Examination, ROC, in the mean time has tried her best to make known to the public those to whom it may concern, in particular the goals, designs and schemes of the new system in order to enhance understanding thereof and reduce unnecessary misunderstanding, if any. How to cope with the new system re Judiciary Exam and Bar Exam accordingly becomes the current issue amongst Taiwan’s legal education institutes. This article introduces the essence and major features of the new system, seeks the possible ways to reshape the deviated law studies influenced by bar-exam-oriented way of learning, and proposes domestic legal education reforms in response to the new system in order to upgrade the legal profession. |
