中文摘要 | 本文從物權編關於所有權規範之法理基礎,以及物權編通則暨所有權通則之發展動向兩個角度切入,闡析現行民法物權編修正所有權之基本規範。本文首先發現所有權之規範基礎,可植根於以物盡其用作為運展所有權機能之標竿、以比例原則作為限制所有權權能之準據、以及以課予第三人探知義務作為促進交易安全之途徑等三項基本法則。其次,對於物權編承認得透過習慣法形成新物權之規定,據以強化了物權法定主義之類型流動性,本文表示贊同,並認為其可通過合憲性之檢驗。此外,本文倡議取得違章建築之事實上處分權的買受人,就其違建房屋遭他人占用或妨害之情形,應有民法第七六七條物上請求權之適用。 |
英文摘要 | The purpose of this article, which is divided into four parts, is to make a commentary on the reform of Rights In Rem concerning the Chapter II Ownership in Taiwanese Civil Code. Following the introduction, Part II sets out three general principles of the ownership law. Part III explores two fundamental orientations in General Provisions of Rights In Rem: one is to integrate customs into the substance of Numerus Clausus Principle and the other is to generalize the rights of the owner of a thing to demand its return from anyone, to the rights in rem other than ownership. Part IV concludes by offering several propositions to Taiwan Supreme Court. |
