中文摘要 | 在我國,對於學校教育和宗教應有的關係和分際,一向隱晦不明。政府即使在憲法和教育基本法中訂有相關的文字來披為指導原則,但是觀諸教育行政機關和學校的實際作為,對於有關政教分際法令之落實似乎並不曾加以特別重視。本文旨在探討美國公立中小學教育與宗教分離的釋憲判例及具體作法,歸納其發展趨勢,並呼籲政府、教育行政當局、法律界、宗教界和教育學術界共同集思廣益,研訂一社會大眾可以接受的準則,以供學校和教師在處理相關問題上的參考。除了前言之外,本文的主要內容第一耜分為美國聯邦憲法的宗教條款及其司法應用、政教分離和宗教中立的區別;第二部分為有關學校教育的政教分離重要釋憲判例,包括校園內祈禱和靜默時刻、宗教教導與讀經、公款補助教會學校以及學生的宗教結社自由;最後並提出對臺灣的啟示做為結語。 |
英文摘要 | In Taiwan, the separation between school education and religion has always been ambiguous in practice, although there are related articles in the Constitution of R.O.C. and statutes in the Education Fundamental Act. Based on U.S. literature, including its Constitution, Amendments and case laws, this paper examines the meanings of the separation of church and state, reviews relevant litigations and court rulings, especially those cases appealed to the Supreme Court, and summarizes the ways and trends in how Americans handled these issues and conflicts. Finally, this paper rages Taiwan’s government, education administrative authorities, administrative authorities, legal experts, scholars in education, and school leaders to take special care in discussing and defining and proper and defensible relationship between schooling and religions, and offer clearer guidelines for school’s daily operations. |
