中文摘要 | 臺灣島四面環,一九八二年聯合國國際海洋法約於一九九四年生效後。臺灣作為一個際法上的主權獨立國家,與鄰近之中國、日本、菲律賓和其他國家在主、海洋資源主權權利及管轄權所產生之爭端已見多起,合理合法解決並日漸迫切。 臺灣爭端主要為:一、兩岸在國際政治上已係一邊一國的事實狀態下的臺灣海峽之法律地及國際行問題;二、北部東海域與中、日三方之二百浬專屬經濟重疊之海域資源劃分;三、與南諸國爭執之南海群島主爭議議題;四、近頃中國所屬科學研究船於臺灣東南部海域進行未經核准之海洋科學研究之合法性問題;五、在臺灣南部海域與菲律賓之漁業資源劃分問題。 上揭五大重要爭端解決之道首要臺灣政府應明確堅守主權獨立國家定位,再偔照一九八二年聯合海洋法公約和既存的公約和習慣國際法規範,方得予合法和平解決。 |
英文摘要 | The Settlement of Dispute for Taiwan’s Contiguous Waters Taiwan is a big island, surrounding by the different seas. Taiwan, as an independent sovereign state in international law, has involved in some disputes on legal issues of the ocean sovereignty, sovereign rights and jurisdictions of living or non-living resources with the PRC, Japan, Philippines, and other states in accordance with the United Nations on the Law of the Sea, 1982 herein after UNCLOS. The disputes reveal many and reasonable solutions are increasingly imminent and urgent. The major disputes are: (1) the legal status and international navigation issues of the Taiwan Strait under “the de facto one side, one state” situation with the PRC in the international politics; (2) the delimitation of the 200 nautical miles Exclusive Economic Zone with the PRC and Japan trisides in the East Sea; (3) the sovereign dispute on the South China Sea with the sates situated around the South Sea; (4) the legality of the PRC’S scientific research ships appearing in the Taiwan’s south-eastern waters and working for the unapproved research; (5) the fishing conflicts with the Philippines in the Taiwan’s partial south waters. The legitimate and peaceful means and measures on the settlement of the five major said disputes are that Taiwan government would firstly take the position on Taiwan’s independent statehood in the international community, and then, abide by the 1982 UNCLOS and the existing conventional or customary international laws. |
