中文摘要 | 表現的自由在日本是受著憲法21條的直接保障,它也包含著收集消息及報導事實的自由,而且此一理念正是為了滿足公眾知的權利,尤其是資訊的自由正是民主的根本。但是另一方面,它並不意味著所有的國家相關資訊都可以毫無限制地被流傳著,特別是關係到了國家安全之相關資訊。所以在何種狀況下,政府才能管制消息的流通,則成為一項爭論的議題。在日本,對此的一些相關爭議,甚至也訴諸法庭,其中以最高法院所做的判決之西山一案最為著名。所以本文則以日本為中心,試著從憲法及法律的觀點,研究並探討此一議題。 |
英文摘要 | In Japan, Article 21 of the Constitution guarantees the freedom of expression. It includes the freedom to gather news and to report facts and ideas in service of the public's right to know, and the freedom of information is at the foundation of democracy. However it does not mean that all national information can be spread without limitation, especially information about national security. Therefore, under what conditions the government can regulate the spread of news has become a contentious issue. Some of these arguments were even appealed to courts in Japan. The most famous case is the Nishiyama case, which was made by the Supreme Court in 1978. This paper focuses on Japan, and intend to study and analyze this issue from viewpoints of the constitution and the law. |
