中文摘要 | 地理名詞得否作為商標,應視地理名詞對商品之意義不同而有別,不能一概而論。地理名詞對商品之意義可能是毫無意義的任意性商標,可能是說明商品產地之記述性商標,也可能虛偽的有欺罔公眾使其誤認誤信為商品產地之虞,或是商品名稱,實務上應就個案考量,釐清地理名詞與所指定使用商品間之關係,才能真正解決商業上實際的問題。 |
英文摘要 | Whether a geographic term can be used as a trademark or not, it depends on what meaning will this geographic term bring to this product. Any geographic term can be used as an arbitary trademark and by which means nothing to the product. It can also be used as a descriptive trademark, which represent from where this product originated. It can possibly be used as a false trademark as well to confuse the origin or name of the product to customers. Therefore, for solving those actual commercial problems, clarification of the geographic term and the relationship between the term and the pointed product should be taken into account by each case. |
