中文摘要 | 土地本身無法如同其他產品可再製並且也是生產的要件之一,正顯示出土地是無 可取代與獨一無二有限性。臺灣地狹大稠,對土地的需求殷切,土地在臺灣而言是屬於稀少 性,政府為達成執行各種產業發展對土地的需求,以及顧及平均地權中「地盡其用、地利共 享」的境界,則運用規劃的方式對土地進行不同使用的用地劃設與編定。在多年施行土地使 用分區管制後,常因不同用地劃設的限制,導致土地所有權人在可享有權益上,受到不同的 限制,而產生不公平的情況。 相關法令中,土地編定各種不同使用項目,對不同項目有高低不同的限制,產生利益不均衡 。此代表不同劃設在法的層面,是否對於私有權人的權益能均衡?確為劃設上的一大隱憂, 故劃設的相關規定對土地所有權益的公平性,應為未來解決權益均衡問題重視的一環。故必 須建構在公與私調和基礎上,使能達對社會公益有正面的幫助,又重視土地所有權人的公平 ,避免公私,與個人之間衝突。就古蹟的公平性而論,古蹟與其他用地使用的土地所有權人 ,在先天上有所差異存在,顯然古蹟保存區的劃設是基於大眾的公益必須加以限定使用,而 一旦劃設之後必須限用並且不得發展,若對於所有權人無相當的補償,其權益就有失公平。 臺灣過去多年來,對於古蹟保存區的劃設業已有相當的成果,但凡是牽涉到私人權益的問題 時,對於劃設的標準與補償的方法就仍有所爭論。過去許多國內專家學者對於古蹟保存與修 復的研究多有著墨,將面臨破壞與滅絕的古蹟加以保護,其中不乏參考國外對於古蹟保存的 方式,如開發許可制、發展權移轉等,目前在實際上並無完全落實,僅是一種構想,但確實 為古蹟保存有所貢獻。本研究希望藉由檢視古蹟用地劃設對私有權益的問題,釐清古蹟用地 所有權益的分野,以達均衡公私之間的權益。最後再以全球的觀點,建議未來臺灣古蹟的發 展方向,使古蹟再發展能夠成為臺灣文化發展重要的一環。 |
英文摘要 | Land cannot be re-produced, and it is also one of necessary production components, which shows that land cannot be re-born and created. In Taiwan, the scarcity of land could not catch up with population growing rate, and the demand of land is growing-up. The government takes on some different approaches such as zonings to balance the land demand of every kind of industrial development. To consider the state of "Maximum the land efficiency and share the land interest with whole society" that is about "Principle on the equalization of land rights." After having imposed zoning control policy for many years, the land-owners lose their own rights because of different zoning limits, and these cause the unjust land use situation. By the related laws, the lands set to many different uses that has different controls that cause land rights imbalance. Therefore, it is important that government should make laws to balance the land rights between public and private. Besides, we should also try our best to find a way to avoid the conflict between them. As a result, we should not only achieve the goal of social equality but also protect the private rights as well. As far as the fair historical buildings be concurred, there are losts of differences exist in restricting land to preserve or not. Because the compensation of restrict area of historical buildings is more than other areas. Approaches such as zoning control and transfer development right systems used by many countries to solve the historical buildings problems. However, most of them considered on the basis of statute and methodology without any philosophy thinking about the historical building issues. In Taiwan, recently many scholars use these approaches to try to solve these problems, but the question that it is appropriate for Taiwan's environment. In order to clarify these complex problems such as who should own the historical buildings land rights. Therefore the paper begins with the identification of historical buildings meaning to explore the historical meaning of property right and land ownership, and the equity. The historical building issues in Taiwan should examine and their policy implications for further research proposed. |
