中文摘要 | 我國正在制定不動產登記法草案,常須參考比較法資料,但我國文獻上對美國不動產契據登記制與托崙斯登記制的介紹甚少,究竟美國法制的現狀為何,對我國有何啟示,有待深究。本文分為四部分:第壹部分提及我國不動產登記法制與美國法可能的相關處;第貳部分參考美國最新文獻,詳盡闡述其登記法制;第參部分將美國登記法制予以歸納、分析,與我國法比較,以提供我國法制與實務運作反思的契機;第肆部分是結論。 美國登記法制對我國有許多啟示,特別是不動產債權契約的公證、不動產租賃或相鄰不動產使用協議的登記、區分所有之專有部分的範圍、區分所有規約的登記、登記謄本與權利書狀上登記的精確時間,以及我國實務上公契與私契之區別等議題。 |
英文摘要 | The government in Taiwan is now drafting the Real Estate Registration Act and in the need to refer foreign real estate registration law. However, few papers introduce the U.S. Deed Recordation System and Torrens Registration System of real estate. Therefore, it is meaningful to explore contemporary U.S. system and its lessons for Taiwan. This article consists of four parts. Part I sets out the possible relationship concerning real estate recordation/registration between Taiwan and the U.S. Part II introduces the U.S. system based on the most updated data and studies. Part III analyzes the U.S. system, compares it with Taiwan’s system and explores lessons for Taiwan. Part IV draws some conclusions. There are a lot of lessons can be draw from the study of U.S. system, especially the issues of notarization of real estate contracts, the recordation of leases or covenants of real estate, the scope of the unit of condominium, the recordation of the declaration of condominium, the explicit recording time of the copy of register and the certificate of title, and the distinction of public contracts and private contracts in Taiwan. |
