中文摘要 | 目前我國朝野所提出之「兩性工作平等法」及「男女工作平等法」兩份草案,正在立法院審議中,如無意外,應可在本會期內正式完成立法手續,使得此一延宕長達九年之重要法律終能產生,而為我國兩性工作平等理念之實現,向前邁進一大步。事實上,在這段期間內,國際上規範兩性工作平等之法制,也有相當程度之變化,而其中幾項新發展趨勢,頗值得我國在建構相同制度時加以關注,一則用以檢視現行之改革措施是否合乎國際脈動,一則也可探討我國在這方面未來努力之方向。 本文之目的,是要說明女性勞動參與及相關立法之各項國際趨勢,並評析我國擬議中「兩性工作平等法草案」之相關規定是否能符合這些新發展。除序言及結語外,共分為四大部分:第一部分說明在各國女性勞動參與及相關立法之大體情形;第二部分列舉幾項國際上兩性平等法制之新趨勢,主要是以美國及歐洲聯盟之發展為探討對象;第三部分則對我國就業上性別歧視之情形及幾項相關改革措施加以說明;最後,本文對國際上兩性工作平等制度之發展趨勢可供我國參考攻錯之處,做一簡要之剖析。 |
英文摘要 | Two Gender Equality in Employment Bill proposed respectively by the ruling and opposition parties are currently under deliberation in the Legislative Yuan. If they are merged and enacted as planned in this legislative session, the new statute will make a tremendous impact on the promotion of the lofty ideal of gender equity in employment in Taiwan. Actually, legal norms governing many aspects of gender equality in employment have also undergone considerable changes in the international community recently. Some of these new developments deserve special attention while Taiwan is striving to adopt a similar system. it is hoped that through the examination of these international trends, whether reform measures in Taiwan are in conformity with these new international standards can be thoroughly assessed and the direction of further reform can also be set. The purpose of this paper is to make an examination of the international trends of female labor participation and of various related statutes adopted in several industrialized countries in coping with these new issues. It also tries to evaluate whether the related provisions contained in the proposed Gender Equality in Employment Bills in Taiwan are matching with these new developments. Aside from introductory and concluding remarks, the paper are divided into four sections. First, it briefly describes the phenomenon of female labor participation in recent years and the general conditions of related statutes. Second, it sets forth several new trends, both positively and negatively, in the development of gender equity in employment laws in the United States and the European Union. In the third section, sex discrimination in employment and a number of reform programs undertaken in Taiwan recently are examined. Finally, the paper proposes that several reform measures be adopted to further the development of the ideal of gender equality in employment in Taiwan. |
