中文摘要 | 「健康食品」如何管理,常成為衛生行政上「灰色區域」。此因健康食品兼具食 品與藥物的特定性質,立法上又難將其與二者區分。由各國衛生立法對健康食品的立法與案 例,皆可見如管理此類商品,實為衛生行政的重大問題。近日行政院衛生署及立法院對健康 食品如何管理,已多有討論。各項健康食品管理草案內容,皆有其可取者。惟民生立法首重 消費者權利的落實,而消費者權利的內涵應以安全、告知、選擇和求償四項均衡為準繩。然 依學者分析,衛生行政主管機關的決策立場多偏向安全性的立場。如何於立法階段考量均衡 ,實為日後有效執行的基礎。本文以爰消費者四大權利的均衡為立論基礎,提出國外立法的 例證,並探討國際食品立法的根本問題,最後提出 1. 多方參與立法研議 2. 衛生母法增修 補正 3. 國際協同合致標準 4. 審理流程結果公開 5. 民間自律方式容許 6. 消費民眾教育 加強等立法原則的建議。 |
英文摘要 | How to regulate Health food is often issue of health administration. This is beacuse of the bilateral properties health food as both foods and drugs, and these are products intimately related to the health and life of humanbeing. To capture the exact meaning and scope, and the definitions of safety and efficacy of foods and drugs, are the essence effective regulation in this field. However, we do see some confusions of regulation here. We need a well-balanced approach in consumer rights and the guideline of current amendment of health food regulations. On the other hand, because of the risk-averse characteristic of offical health regulatory organizations in their risk-benefit decision making, ways of how to balance consumers rights should be considered in the legislative stage. To assure the rights of consumer, six guidelines are proposed as directions for our health food regulations: 1. participants of mixed portfolio, 2. amendments of basic food and drug laws, 3. harmonization of international standard, 4. transparency and publicity of regulatory process, 5. participation of selfregulatory organizations, 6. enhancement of consumer education. |
