中文摘要 | 國貿條規之危險移轉,與保險契約承保期間,兩者間常無法一致,若貨物不慎發生毀損滅失情事時,在海上保險實務中,判斷賠案是否成立,需考量索賠者是否具有保險利益,並檢視發生損失是否在保險期間內所承保。本研究以 Incoterms®2010為主軸,對於危險移轉時點、運費及保險範圍進行初步分析。另針對實務作業上,以保險利益之定義及存在時點與轉讓等進行探討,進而加以分析協會貨物保險條款保險期間與國貿條規危險移轉之銜接點,並對於進行國際貿易買賣雙方間,投保貨物保險之規劃與保險理賠問題等深入研究分析其影響。 |
英文摘要 | Bear risk of International Commercial Terms and duration of cargo insurance are not the same. In marine insurance practice, it depends on damage or loss of goods in different circumstances. We need to consider several factors when we set up cargo damage claims:The risk point in determining the burden whether the claimant has an insurable interest, and view whether the loss occurs within the period of insurance coverage. This study focuses on Incoterms®2010, it summarizes the relevant literature such as Incoterms background and content of the amendments. Besides, for practices on the definition of the insurance benefits, existing point and transfer are discussed. It analyzes duration of Institute Cargo Clauses, Incoterms risk transfer and the convergence point. |
