中文摘要 | 本文之目的在擷取日本勞動派遣法制度的優缺點以作為吾國未來立法時的參考依據。日本勞動派遣法於1985 年制定後數度修改,並極度朝規制緩和(鬆綁法令)方向傾斜,遂產生大量的派遣勞工,進而拉大貧富差距,造成2009 年眾議院選舉,長期執政的自民黨大敗的結果。可知派遣勞動法制度的優良與否關係到政黨輪替,並足以動搖國本。本文基於以上的觀點,遂以法律社會學的手法,強調參考日本法制度時,應注意現階段的政經背景,才能做出最佳的選擇。 |
英文摘要 | This paper is a study of the pros and cons of Japanese Temporary and Agency Staff Law, so as to be a reference for future legislation in Taiwan. Since 1985, the Japanese Temporary and Agency Staff Law has been revised several times to be more flexible in relation to other laws. The result has been an increasing number of temporary and agency workers, more severe discrepancy between the rich and the poor, and even the failure of the ruling party in 2009 election. In this sense, the Temporary and Agency Staff Law is closely related to party politics and state stability—this no doubt invites serious attention. This sociological study advocates the need to incorporate the Japanese experience of the law with the present politico-economic situation as reference, to make the best decision in the future. |
