中文摘要 | 本文檢討有關我國勞動市場彈性化政策與部分工時均等待遇原則之關係,並就國內部分工時均等待遇原則之法理、立法論及實務上之各項問題,參酌 ILO 公約及日本的立法例進行比較和檢討。我國勞動市場彈性化政策是以鬆綁勞動保護法規來達到為企業節省人事成本、大量增加非典型僱用以緩和失業問題為目的,對於勞工生活或生涯規劃之調和並沒有助益。真正能符合勞工需求的部分工時制度是透過立法政策,確定部分工時均等待遇原則。均等待遇原則不僅適用於部分工時勞工,亦已成為整個非典型僱用的基本原則。 |
英文摘要 | This paper is to analyze the relationship between the flexibility of labor market and equal treatment for part-time worker in Taiwan, also compare with the legislation in Japan and related international conventions. In order to resolve the problems of unemployment and reduce Taiwan,s unemployment rate, many argues that government should deregulate the laws on labor and atypical employment so the enterprise can reduce human resources cost in order to create more employment opportunities. However, the above deregulation cannot benefit the labor unless the equal treatment principle is secured through legislation. |
