中文摘要 | 從世界銀行之憲章可知,其為一個以追求經濟發展為宗旨之國際金融組織,形式上不包含人權保障之目的。但是在許多人權政府及非政府組織及國際輿論,對於世界銀行之貸款業務所涉及之人權爭議,提出強烈質疑以及在其本身業務發展之必要性下,世界銀行在組織上以及實質業務發展上,已產生與設立初期不同之業務內容與型態。本研究之目的,並非在探究世界銀行在國際法中對人權保障是否具備實然性的法律基礎,抑或應負保障人權之義務。而是從世界銀行設立之發展宗旨為基礎,就調查工作小組之設立及案例運作,觀察世界銀行之業務與調查工作之運作對人權保障有何影響,進而探究世界銀行對人權保障所扮演之角色如何。在此目的下之研究過程,本文將對世界銀行面臨全球化環境之挑戰,就其發展協助業務目標調整之理念對人權的影響,及就調查工作小組制度之設置歷史、制度及性質予以分析。並由調查工作小組在「奈及利亞溝渠及衛生下水道計畫案」、「查德喀麥隆油管計畫案」以及「柬埔寨森林特許權管理和控制實驗項目計畫案」中,對請求當事人所提出世銀在該計畫中對人權之違反主張,所做成之決定內容,以及其他世銀之實踐,探究世界銀行發展業務與人權互動關係下之規範意義。本文將在第二章對世界銀行之設立歷史理念、宗旨及組織為分析,於第三章就調查工作小組之設立緣由、目的、組織、性質及調查程序為分析,於第四章對三件涉及人權爭議之案例為探討。本文在對工作小組涉及人權主張之案例及其他世界銀行主要機關對發展業務實踐分析後,所做成之結論為,世銀發展貸款計畫及業務與人權保障係相輔相成,而世銀雖非人權保障監督者,卻是透過促進發展的過程,成為人權的實質實踐者。 |
英文摘要 | As an international financial institution with development objectives, the World Bank has established a regime which is fairly unique for all international organizations, that is the Inspectional Panel. The Inspectional Panel, a special and independent system created by the Executive Director of the World Bank in 1993 has a fifteen-year of operation. It is the appropriate time to exam what it has achieved and evolved for the World Bank, especially form the perspective of development and human rights. The aim of this article is not to argue if the World Bank has the obligations to protect human right in terms of international law, but to survey how development and human rights interact with reinforce each other, and what normative implications do that mean for the World Bank. This article will then starts from analyzing how the conception of development evolved under the political restriction clause of the Agreement of Article of the World Bank, then gives a detailed study on the history and objectives of the Inspection Panel. Furthermore, this article will study on the three cases embrace human rights issues and analyze the human rights implications of these cases to the development objectives of the World Bank. The findings of this article are despite of the lack of international law obligations to protect and fulfill human rights formally, the development objectives of the World Bank would not be substantively achieved by ignoring human rights, and form some positive observation of World Bank's development projects and policies, it has become a material actor to achieve human rights. |
