中文摘要 | 人類胚胎幹細胞研究備受囑目,南韓黃禹錫捏造研究事件突顯出,南韓國內與國際治理架構的薄弱。此一事件並末中止各國繼續進行相關研究,許多國家甚至開放或加強對體細胞核移轉的研究,同時強化幹細胞研究的治理架構。國際幹細胞研究協會為促成國際合作、爭取大眾的支持,特別在2006年底發表「胚胎幹細胞研究守則」,對我國界定研究界限並強化治理架構產生重要影響。法律保留原則決定了我國繼受國際守則的形式。人工生殖法第21條第5項粗略地規定人工生殖剩餘胚胎可供研究之用,並不符合法律明確性的要求。單純以職權命令規定政府補助幹細胞相關研究的要件也不符合法律保留的要求。我國決定大幅開放幹細胞研究類型的同時,必須強化幹細胞研究的倫理審查以及明白知情同意,並解決卵子取得的困難。 |
英文摘要 | The Woo-Suk Hwang scandal in South Korea put spotlight on the weakness of Korean as well as international governance structures. However, the event does not prevent countries further pursuing this cutting edge research. Many countries even take a more liberal policy after the scandal, while strengthening their governance structures. In order to promote responsible, transparentand uniform practices worldwide, the ISSCR has issued “Guidelines for the Conduct of Human Embryonic Stem Cell Research”, which exerts enormous influence on the overhaul of regulation framework for ES cell research in Taiwan. The requirement of statutory authorization pre-determines the pathway of Taiwan's reception of ISSCR guideline. Paragraph 21 sec. 5 of the newly enacted “Human Reproduction Law”, stipulates briefly the use of IVF remaining embryos, not meeting the requirement of legal certainty. The new “Ethical Guideline for the Conduct of Human Embryonic Stem Cell Research” defines permissible experiments widely and narrows down impermissible research. This liberal stance can only be legitimized, as rigorous ethical standards will be strictly abided by through the ES cell research oversight mechanism. Recently, scientists have reprogrammed human skin cells directly into so called induced pluripotent stem cells, looking and acting like ES cells. |
