中文摘要 | Beauchamp & Childress 提出四項生醫倫理原則:尊重自主、不傷害、有利、正義,但本文提出民主審議(democratic deliberation)為第五項原則。生醫研究倫理的發展,來自於對歷史上研究者曾進行的殘酷不人道試驗的反思,而欲強化研究者的專業自律,並對受試者的自主權加以尊重。但本文觀察國際人權公約及美國國家生物倫理委員報告等文件,發現為因應目前科研及其倫理規範民主赤字的危機,前列各文件似乎隱含著以民主審議強化研究倫理的共識。台灣人體生物資料庫引發諸多公眾的倫理爭議,顯現該計畫民主正當性的不足,本文認為應透過民主審議原則的實現加以補強。惟現行人體生物資料庫管理條例雖然就告知同意、資訊隱私、利益分享等主要倫理議題加以規範,但如何強化公眾參與,適度的賦權參與者,並建立審議的共識形成機制,是現行生物資料庫相關規範所缺乏的。 |
英文摘要 | Building from the four commonly recognized biomedical research principles of Beauchamp and Childress - respect for autonomy, nonmaleficence, beneficence, and justice-- this article argues that democratic deliberation functions as the fifth principle. Reflections on the cruel and inhuman human subject research in the history figured largely the development of biomedical research ethics, and thus professional self-regulation and respect for subjects’ autonomy have evolved as the core issue. However, by reviewing international biomedical research protocols and the latest reports made by the Presidential Commission for the Study of Bioethical Issues, this article finds democratic deliberation has become a consensus as a response to the democratic deficits of scientific research and research ethics. Following this observation, this article further examines the controversial on Taiwan Biobank project and argues deliberative democracy could answer the primary critique, namely the problem of lacking democratic legitimacy. Although the current Biobank Act in Taiwan provides a regulatory framework on core ethical issues such as informed consent, information privacy, benefit-sharing, empowering public participation to build a regular deliberative consensus-forming mechanism is what this project essentially needs. |
