中文摘要 | 營建工程為一件作業項目繁多、關係複雜且涵蓋人員層面甚廣之工作,加上工程環境上之 變數較大,也因此有諸多因素足以產生工程爭議與糾紛。公共工程由規劃、設計、招標、施工、 驗收及保固,履約期限冗長,期間皆會產生爭議,但施工階段之履約爭議最為複雜,對工程成 敗影響最大,工程爭議若時間過長,則可能造成時間、人力以及經費之浪費。 本研究以契約的角度概念切入討論,而其中有自然及人為等諸多原因,長期的工程契約中 欲預測將來可能發生所有事情的變化,乃極為困難且高成本知識,另一方面由於相關法規及合 約之規定亦未必落實,因此實務上工程變更設計及履約疑議,幾乎是難以避免。本研究係以藉 此了解其種類、特性、可能產生之原因及影響並藉由案例分析思考如何防範變更設計時產生之 各種爭議的發生。 |
英文摘要 | A construction project usually consists of many complicated operating tasks and involves many people in it. In addition, disputes and conflicts arise frequently due to the high variability of engineering environment. Disputes can occur in any stage during the long compliance period from planning, design, tender, construction,acceptance to warranty. However, the compliance disputes during the construction stage are the most complicated ones and have the greatest impact on the success of the engineering. It may cause a waste of time,manpower, and funds. In this study, the viewpoint of contract is adopted to study many natural and man-made causes. It is extremely difficult and costly to predict everything that may occur in the future of the long-term engineering contract. On the other hand, in practice engineering design changes and compliance conflicts are almost unavoidable due to the rules and regulations may not be implemented. The purpose of this study is to understand the types, characteristics, possible causes, potential impacts and to prevent various conflicts arising from design changes through case studies. |
