中文摘要 | 土地交易是中國帝制時代「二千年一貫」的問題,其中宋代土地交易法制較之前代獨具特色。典、親鄰優先、墓鄰優先等制度的存在,既遏制了土地充分自由流轉,又使得土地能以一種被時人接受的方式發生交易。南宋土地交易法制反映了當時的社會變化,同時也促進了社會的變化。其中的經驗和教訓值得我們深思。 |
英文摘要 | Land transaction, was a consistent issue in traditional China. The land transaction law of the Song dynasty was relatively characteristic. As special legal systems, the existence of Dian (approximately equivalent to mortgage), priority of relatives, priority of the one who had graveyard of his ancestor, and so on, restrained the transactions of land, but at the same time it made the transactions happened in a way which people can accepted at that time. The land transaction law of the Southern Song dynasty reflected the changes of the society. Furthermore, it promoted the changes of society. We should attach importance to the experiences and lessons in it. |
